El trabajo ofrece un análisis crítico a la noción de cuerpo propio (Leib) en M. Merleau-Ponty, como superación del dualismo cuerpo-mente. Se amplía dicha noción para integrar las experiencias del cuerpo físico (Körper) y posibilitar el diálogo entre fe-nomenología y medicina, al proponer una fenomenología del organismo doliente.

Esta investigación implica el dialogo entre dos disciplinas o campos de análisis: por un lado, la perspectiva fenomenológica de la enfermedad y, por otro, una perspectiva científica biomédica. Se analiza la relación entre la mirada del cuerpo, de carácter objetivante, y un tipo de injusticia epistémica que surge de ella. El objetivo es proponer una lectura sartriana de la peculiar relación médico-paciente y sus consecuencias éticas. Palabras claves: enfermedad, fenomenología, mirada, injusticia epistémica.

El presente artículo trata sobre cómo la fenomenología del dolor físico puede entablar un dialogo con las ciencias médicas, brindando, por un lado, un marco teórico sobre la relación mente-cuerpo que no sea reduccionista y, por otro lado, algunos aspectos que mejoren la posibilidad de la cuantificación del dolor mediante test de evaluación del dolor, a partir del refinamiento de los reportes subjetivos. En este artículo propongo una conexión entre la regla de reconocimiento de H. L. A. Hart y la tesis de contenidos mínimos de derecho natural del mismo autor. La regla de reconocimiento es comprendida como una regla convencional constituida por la práctica de los funcionarios judiciales encargada de aplicar criterios de validez, para determinar si las normas particulares pertenecen al sistema. Los contenidos mínimos de derecho natural constituyen la base de tendencias o instintos de los humanos en su búsqueda de (...) supervivencia. A partir de los planteamientos de Marmor y Raz, se propone que en la regla de reconocimiento los contenidos mínimos de derecho natural constituyen el primer filtro de evaluación de la validez de las normas jurídicas particulares sometidas a reconocimiento jurídico, lo cual aporta solidez y consistencia significativa a las tesis de la discrecionalidad y de la separabilidad de la teoría hartiana. Socially responsible human resource management (SR‐HRM) is becoming increasingly important for academics and managers. The interface between HRM and corporate social responsibility (CSR) is the subject of analysis in this article. It adopts a contextual perspective to analyze whether the institutional context influences the implementation of socially responsible HRM (SR‐HRM). Considering the differences in the national institutional contexts across Europe, this study explores the different models of SR‐HRM in that region. The research is focused on a sample of 153 companies (...) headquartered in Germany, Spain, Sweden, and the United Kingdom. The findings evidence the influence exerted by the national institutional context on the implementation of SR‐HRM. Differences among country clusters suggest the existence of different models of SR‐HRM in Europe. However, these models do not correspond to the blocks on HRM or on CSR identified by the literature but instead provide a novel categorization. (shrink)

Background: This research explores how public awareness and attitudes toward donation and transplantation policies may contribute to Spain's success in cadaveric organ donation. Materials and Methods: A representative sample of 813 people residing in Andalusia (Southern Spain) were surveyed by telephone or via Internet between October and December 2018. Results: Most participants trust Spain's donation and transplantation system (93%) and wish to donate their organs after death (76%). Among donors, a majority have expressed their consent (59%), and few nondonors have (...) expressed their refusal (14%). Only a minority are aware of the presumed consent system in force (28%) and feel sufficiently informed regarding the requirements needed to be an organ donor (16%). Participants mainly consider that relatives should represent the deceased's preferences and be consulted when the deceased's wishes are unknown, as is the case in Spain. Conclusion: Public trust in the transplant system may contribute to Spain's high performance in organ donation. High levels of societal support toward organ donation and transplantation do not correspond with similar levels of public awareness of donation and transplantation policies in Spain. (shrink)

Problema de investigación abordado en esta tesis de grado, fue el de explorar el alcance que tendría la conexión entre la tesis de la regla de reconocimiento y la tesis de los contenidos mínimos de derechos natural en la teoría de H.L.A. Hart. Se indaga a partir de las referencias directas y no directas, la contextualización histórica con escuelas o tendencias activas en el período de elaboración de "El Concepto de Derecho". para identificar los puntos relevantes que permiten desarrollar los (...) enlaces que inicialmente se plantean. Alcance para entender el trabajo maduro de Hart sin olvidar que ya en obras anteriores surgen las aproximaciones a la pragmática del lenguaje y el lugar que asigna a las "reglas prácticas" del derecho en el contexto social. Se culmina apoyada la argumentación en algunas tesis de J Raz en en caracter constitutivo de la regla de reconocimiento y por lo tanto, en su naturaleza de regla primaria y no secundaria como es ubicada por Hart en la obra mencionada. The article is located in the iusphilosophical scenario of the mid-twentieth century. Its objective is to trace the sources of Hart's rule of recognition, taking as its starting point the thesis that makes such rule a weighted response to the debate between the Kelsenian formalism and the utilitarian theory of Bentham and Austin in the first instance. This is explored in the sources recognized and not recognized by the author himself since the article claims a decisive presence in methodology of (...) direct ancestors such as Hobbes, Hume, Malinowski, among otrs. These do not grant to the mentioned rule of recognition a mere conciliatory desire of the previous traditions, but they rather define the nature of the rule and the need for it to be addressed from interdisciplinary fields because it can bear fruit for the analysis of the underlying principles in judicial practice from the exploration of speech in context. Proponemos una teoría estética basada en un enhebrado cronotópico del discurso creativo que replantea las lógicas de constitución del sujeto. Tomamos como hilo conductor la película La voz de la luna (La voce della Luna, 1990) de Federico Fellini, cuyo surrealismo, lejos de suponer una construcción al azar de un relato, revela una sofisticada narrativa desde lo circunstancial (y no desde el sujeto o el objeto). Es aquí donde confluimos con las tesis más radicales de Antonin Artaud y su proyecto (...) político basado en el teatro de la crueldad y la reificación del fragmento-órgano. Concluimos con un alegato por una narración vital, que trascienda la obra, disipe la posición del sujeto en la misma (lo que Jacques Derrida denomina Forcener le subjectile) para que el sentido de la humanidad, en lo ínfimo y fragmentado, trasparezca. Responding to recent concerns about the reliability of the published literature in psychology and other disciplines, we formed the X-Phi Replicability Project to estimate the reproducibility of experimental philosophy. Drawing on a representative sample of 40 x-phi studies published between 2003 and 2015, we enlisted 20 research teams across 8 countries to conduct a high-quality replication of each study in order to compare the results to the original published findings. We found that x-phi studies – as represented in our sample (...) – successfully replicated about 70% of the time. We discuss possible reasons for this relatively high replication rate in the field of experimental philosophy and offer suggestions for best research practices going forward. (shrink)

Theories of embodied cognition hypothesize interdependencies between psychological well-being and physical posture. The purpose of this study was to assess the feasibility of objectively measuring posture, and to explore the relationship between posture and affect and other patient centered outcomes in breast cancer survivors with persistent postsurgical pain over a 12-week course of therapeutic Qigong mind-body training. Twenty-one BCS with PPSP attended group Qigong training. Clinical outcomes were pain, fatigue, self-esteem, anxiety, depression, stress and exercise self-efficacy. Posture outcomes were vertical (...) spine and vertical head angles in the sagittal plane, measured with a 3D motion capture system in three conditions: eyes open, eyes open relaxed and eyes closed. Assessments were made before and after the Qigong training. The association between categorical variables was measured by Cramer’s V. In the EO condition, most participants who improved in fatigue and anxiety scales also had better vertical head values. For the EOR condition, a moderate correlation was observed between changes in vertical head angle and changes in fatigue scale. In the EC condition, most of the participants who improved in measures of fatigue also improved vertical head angle. Additionally, pain severity decreased while vertical spine angle improved. These preliminary findings support that emotion and other patient centered outcomes should be considered within an embodied framework, and that Qigong may be a promising intervention for addressing biopsychosocially complex interventions such as PPSP in BCSs. The aim of this study was to analyze the psychometric properties of the Eating Disorder Inventory (EDI)-3 test to evaluate eating disorders in young Chilean population. Methods: The sample consisted of 1,091 Chilean adolescents and young people (i.e., 476 men and 615 women) between 15 and 28 years old, from the metropolitan region, and four regions from the coast and south-central zone of the country. The reliability and factorial structure of the instrument were analyzed, replicating the confirmatory factor analyses ofBrookings (...) et al. (2020), evaluating four additional models that included bifactor exploratory structural equation modeling (ESEM), bifactor, and two-bifactor. Results: A majority of the subscales presented alphas and omegas equal to or greater than 0.70, with the exception of asceticism (α = 0.543, ω = 0.552) and interpersonal alienation (α = 0.684, ω = 0.695) scales, which are consistent with the values of the Spanish and Mexican non-clinical samples. The best fit indices were obtained by the ESEM two-bifactor model, with twelve specific factors corresponding to the EDI-3 subscales and two general orthogonal factors (i.e., risk subscales and psychological subscales), consistently with the theoretical basis. The aim of the present study is to analyze individual differences in academic self-efficacy within a population of Unaccompanied Foreign Minors from the European cities of Ceuta and Melilla. Variables describing educational level and length of stay were considered in a sample of 377 individuals being cared for in different youth centers. Of these, 63.4% belonged to the group who had stayed at the center for less than 9 months and 36.6% reported a length of stay of more than 9 (...) months. The age of participants ranged between 8 and 17 years old. Once the quality parameters of the instrument were elaborated, reliability and validity was confirmed through Confirmatory Factor Analysis using Structural Equation Modeling methodology. Data collection was then initiated. The results overall indicate that 87.6% of those who completed the questionnaire reported a higher level of self-efficacy with regards to working with any classmate, whilst at the same time seeing themselves as capable of achieving good marks. ANOVA results indicated significant differences with respect to educational level and length of stay. In this regard, students who had received professional training and had been at the Center for more than 9 months, were the ones who developed greater academic self-efficacy for spending more time working when tasks were judged to be difficult. The results obtained demonstrate that any intervention will be positive as long as it promotes different institutions to develop strategies that cater to a length of stay of more than 9 months and target education, academic self-efficacy, socialization and strengthening the future workforce. Such interventions can be directed through new European, Spanish or local level policies. It is clear that institutions still have a lot of work left to do. (shrink)

Replicability is widely taken to ground the epistemic authority of science. However, in recent years, important published findings in the social, behavioral, and biomedical sciences have failed to replicate, suggesting that these fields are facing a “replicability crisis.” For philosophers, the crisis should not be taken as bad news but as an opportunity to do work on several fronts, including conceptual analysis, history and philosophy of science, research ethics, and social epistemology. This article introduces philosophers to these discussions. First, I (...) discuss precedents and evidence for the crisis. Second, I discuss methodological, statistical, and social-structural factors that have contributed to the crisis. Third, I focus on the philosophical issues raised by the crisis. La gestión del conocimiento es un proceso relacionado con la producción, transmisión y utilización del conocimiento y su pertinencia para el desempeño organizacional; en la actualidad han aparecido diversidad de modelos que prescriben su configuración. El presente artículo describe el modelo que fundamenta teórica y metodológicamente la aplicación de la gestión del conocimiento en el Centro de Desarrollo de las Ciencias Sociales y Humanísticas en Salud. Esta entidad dedicada a la producción y transmisión del conocimiento científico en estas áreas de (...) conocimiento, no contaba con un modelo que permitiera estructurar el funcionamiento del proceso de su construcción y difusión en su interior y hacia el contexto. El modelo propuesto atiende la especificidad de los procesos de la entidad, y guía teórica y metodológicamente los flujos de información y conocimientos, las redes de actores presentes y los procesos de gestión de conocimiento que se integran en la dinámica de la organización. Knowledge management is a process related to the production, transmission and use of knowledge and its relevance to the organizational performance; nowadays there are several models that prescribe its configuration. This article describes a model that theoretically and methodologically bases the implementation of knowledge management on the Centre for the development of social and humanistic sciences in Health. This entity devoted to the production and transmission of scientific knowledge in these areas of knowledge, did not have a model that allow to structure the operation of its construction and diffusion process from inside and towards the context. The proposed model deals with specificities of the entity´ s processes, and theoretically and methodologically leads flows of information and knowledge, networks of actors and knowledge management processes that are integrated into the dynamics of the organization. Black holes are arguably the most extraordinary physical objects we know in the universe. Despite our thorough knowledge of black hole dynamics and our ability to solve Einstein’s equations in situations of ever increasing complexity, the deeper implications of the very existence of black holes for our understanding of space, time, causality, information, and many other things remain poorly understood. In this paper I survey some of these problems. The U.S. Foreign Corrupt Practices Act has gained significant popularity in recent years across borders due to the increased investigation and penalties under the law. The following case is a real-life case that highlights the main provisions of the FCPA. Using cases in teaching an auditing or ethics course is much needed to develop students’ professional judgment, critical and analytical thinking skills and communication skills. Presently, there are a few cases that address the Foreign Corrupt Practices Act and its effect (...) on financial reporting and auditor responsibilities about illegal acts. The Armor Holdings case is interesting and information is publicly available regarding the circumstances that describe the bribery act, lack of whistle-blower protection, the tone at the top, and the accounting treatment. In addition, the increase in actions brought by the Securities and Exchange Commission under the FCPA since 2010 heightens the relevance of this case and underscores the need for students to learn the skills necessary to ensure compliance with FCPA and related key regulations such as the Sarbanes Oxley and the Dodd Frank Act. Therefore, cases like this one provide a rich tool to navigate topics and enforce students’ learning of client’s illegal actions and their consequences. These skills are invaluable in practice. Are sexual orientations freely chosen? The idea that someone’s sexual orientation is not a choice is very influential in the mainstream LGBT political movement. But do we have good reasons to believe it is not a choice? Going against the orthodoxy, William Wilkerson has recently argued that sexual orientation is partly constituted by our interpretations of our own sexual desires, and we choose these interpretations, so sexual orientation is partly constituted by choice. In this paper I aim to examine the (...) question of whether our interpretations of our own sexual desires are constitutive of our sexual orientations. I will argue that whereas Wilkerson’s argument for the claim that sexual orientations are in part constituted by our chosen interpretations of our sexual desires is not sound, there are good reasons for endorsing a weaker claim, namely, that there are different but equally apt descriptions of the same sexual desires, depending on which concepts we have. Her research focuses on changes in women's brains during pregnancy1. Rowena plans to use magnetic resonance imaging to record images of the brains of women in the second and third trimesters and after birth at 6 and 24 weeks. Her sample consists of two groups of healthy women with uncomplicated and singleton pregnancies, (...) the first primigravid and the second multiparous. This article investigates the doctrine of intellectual memory in Descartes. In his writings, Descartes recognized not only a bodily memory, explainable in purely physiological terms, but also an intellectual or spiritual memory. In this article, I investigate whether Descartes postulated an intellectual memory for theological reasons or for philosophical reasons. From the analysis of certain texts in which Descartes explains what intellectual memory is, the paper will show that Descartes appeals, for strictly philosophical reasons, to intellectual memory to explain some (...) processes of reminiscence that occur in the human being. In contrast to what some contemporary commentators on the Cartesian doctrine of memory have argued, Descartes’s motivations for postulating intellectual memory are not theological. (shrink)
